The short version
Under 49 CFR Part 40, the U.S. Department of Transportation requires every safety-sensitive employee who tests positive, refuses a test, or otherwise violates DOT drug and alcohol regulations to complete an evaluation with a qualified Substance Abuse Professional. Your SAP is the only person who can recommend the education or treatment you need and clear you to take your return-to-duty test.
The four stages of the DOT SAP process
1. Initial SAP evaluation
A face-to-face or telehealth clinical assessment. Your SAP reviews your history, current circumstances, and the violation. The session typically takes 60–90 minutes.
2. Education or treatment
Based on the evaluation, your SAP recommends a specific course of education, counseling, or treatment. You must complete the recommended program — not a different one.
3. Follow-up evaluation
After you finish the recommended program, you return for a follow-up evaluation. The SAP determines whether you have demonstrated successful compliance.
4. Return-to-duty (RTD) test & follow-up plan
Once cleared, your employer arranges a directly-observed return-to-duty drug or alcohol test. Your SAP also issues a follow-up testing plan that you must complete.
Why a qualified SAP is required
DOT does not allow just any counselor or therapist to perform a return-to-duty evaluation. Under 49 CFR §40.281, a Substance Abuse Professional must hold specific clinical credentials, complete DOT-specific qualification training, pass a knowledge exam, and meet ongoing continuing-education requirements. If your evaluation is performed by someone who does not meet these requirements, the entire process is invalid and you cannot return to safety-sensitive duty.

The DOT SAP program in Pennsylvania covers any worker in a DOT-regulated safety-sensitive role — CDL drivers under FMCSA, pilots and aviation personnel under FAA, transit workers under FTA, railroad workers under FRA, pipeline workers under PHMSA, and USCG-credentialed mariners. How long does the SAP process take?
The initial evaluation itself is a single appointment. The total return-to-duty timeline depends on what your SAP recommends — a short education program may take a few weeks, while more intensive treatment can take longer.
