Failed or refused DOT test
Your MRO (Medical Review Officer) reports the verified positive result, or your employer documents a refusal. This triggers DOT's return-to-duty requirements under 49 CFR Part 40, Subpart O.

Immediate removal from safety-sensitive duty
Your employer must remove you from any safety-sensitive function — driving, flying, dispatching, operating equipment. Your Designated Employer Representative (DER) provides you with a list of qualified SAPs in your area.

Initial SAP evaluation
You contact a qualified Substance Abuse Professional and schedule your evaluation. This is a clinical assessment, not a punishment — the SAP determines what education or treatment is appropriate for your situation.

Complete the recommended program
Your SAP refers you to specific education or treatment. You must complete exactly what is recommended. Your SAP communicates directly with the program to confirm successful participation.

Follow-up evaluation
After the program, you return to your SAP for a follow-up evaluation. The SAP determines whether you have demonstrated successful compliance and issues a follow-up report to your DER.

Return-to-duty (RTD) test
Your employer arranges a directly-observed return-to-duty drug or alcohol test. A verified negative result is required before you can resume safety-sensitive duty.

Follow-up testing plan
Your SAP issues a follow-up testing plan requiring a minimum of six unannounced tests in the first 12 months. The plan can extend up to five years depending on your situation.
Important compliance notes
- Only a DOT-qualified SAP can perform the evaluations and issue the required reports.
- Your SAP cannot also provide your treatment — these roles must be separate under Part 40.
- Your follow-up testing plan follows you to any future DOT-regulated employer.
- Records are maintained per DOT's required timelines; you have the right to a copy.
