What you don't get
We won't share your employee's clinical record with you — DOT prohibits it. You receive only what 49 CFR Part 40 requires the DER to receive: the recommendation, compliance status, and follow-up testing plan.

Frequently asked by DERs
Can we require our employee to use a specific SAP?+
No. Under 49 CFR §40.287, you must provide the employee a list of qualified SAPs and acceptable substance abuse treatment providers, but the choice of SAP belongs to the employee.
What does the DER receive from the SAP?+
The DER receives the SAP's written recommendation, compliance status updates, and the follow-up testing plan. The DER does not receive the employee's clinical record.
How does the SAP coordinate with our DER?+
We work directly with your DER for all required communications — recommendation, compliance status at the follow-up evaluation, and the follow-up testing plan. We can be added as a contact in your testing program.
Do you handle FMCSA Clearinghouse SAP reporting?+
Yes. For CDL drivers, we enter all required SAP records (qualified-SAP designation, RTD eligibility, and successful completion) into the FMCSA Clearinghouse on the appropriate timeline.
